Counters Linky installed at a sustained pace throughout France by Enedis cause here and there tensions in the private individuals who do not want the refined monitoring of the electrical consumption allowed by the regular transmission of information of the housings in CPL (powerline in line) or for fear of the possible consequences on their health.
Remedies have been filed against facilities that are sometimes forced, or at least unwanted. In the Tours region, out of 120 individual cases demanding the withdrawal of the Linky meter, the district court finally asked for the removal of smart meters in 13 cases.
Although the vast majority of applications were rejected, these 13 files were validated for medical reasons. One of them is particularly highlighted in the media because it is the case of a 7 year old child whose states of chronic fatigue and difficult sleep, recognized by medical certificate, are potentially attributed to the installation of a Linky meter.
In this case, the court claims a "electricity-free electricity delivery onlineIn other cases, the requests concern the abandonment of meter installation projects and the installation of filters when they are already present.
The validation of cases for medical reasons is essentially based on the application of the precautionary principle (and not the direct demonstration of the dangerousness of the installation) and the fact that the ANSES report (National Health Security Agency) published in June 2017 did not identify any particular danger but pointed health uncertainties deserving additional studies, as often in this type of complex file.
This vagueness was put forward by the plaintiffs' lawyer to justify a risk of "imminent damage"for electro-hypersensitive people, to which the high court has been receptive.
Enedis immediately decided to appeal the decision, as the company did in other cases elsewhere in France, arguing the safety of its smart meters and the extreme rarity of cases of hypersensitivity to the waves in the population.
