American actor Cuba Gooding Jr will be judged in September for unsolicited charges of touching, a New York court having dismissed his request for a nonsuit.
The New York native, Oscar for best second role in 1997 for his role in "Jerry Maguire", is accused of having felt the chest of a woman in a bar in Manhattan last June.
Mr. Gooding denies the charges and his lawyers ensure that surveillance camera images from the bar clearly show that their client is not guilty.
He faces a year in jail
But New York State Criminal Court Judge Phyllis Chu on Wednesday dismissed their motion to dismiss the case. "The court considers that the accused has not presented convincing reasons to justify a dismissal", said Mme Chu in a written decision of which AFP got a copy. The trial is scheduled to begin on September 3rd.
Unsolicited touching is punishable by up to one year in prison under New York State law.
Cuba Gooding Jr., 51, is known to the film "Boyz's n the hood, the law of the street" (1991). He recently starred O. J. Simpson in the mini serie "American Crime Story".
